Right of withdrawal

In accordance with art. 52 of the Legislative Decree 6 September 2005 n. 206 (the "Consumer Code"), you have the right to withdraw from the contract signed with MARLI & CO. Srl (the "Seller" or "MARLI & CO.") Without any penalty and without giving any reason, within 14 days from the day you received the products purchased on marliandco.it.

In accordance with art. 54 of the Consumer Code, you can exercise the right of withdrawal using, at your choice, one of the following methods:

a) online transmission to the Seller of the Return Form that you find in the Returns and Exchanges area, completed in full and declaring that you wish to withdraw from the sales contract; in this case, the Seller will send you confirmation by e-mail that the declaration of withdrawal has been received;

b) sending by post to the Seller Registered A / R, compliant with the standard form pursuant to art. 49, paragraph 4, of the Consumer Code, to be completed in full;

c) sending by post to the Seller another explicit declaration of your decision to withdraw from the contract.


In cases b) and c), your declaration must be sent to the attention of the Customer Service at the headquarters of MARLI & CO. Via Topino 35, 00199 Rome. It is understood that, in such cases, the burden of proving the correct and timely exercise of the right of withdrawal will be your responsibility.

In accordance with art. 57 of the Consumer Code, once the withdrawal from the contract has been exercised, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you notified the Seller of your decision to withdraw from the contract.

In accordance with art. 59 of the Consumer Code, the right of withdrawal is excluded in the event that you have purchased tailor-made or customized products or sealed goods that are not suitable to be returned for hygienic reasons or related to health protection and have been opened after the delivery.


1. Conditions for exercising the right of withdrawal in accordance with art. 52 of the Consumer Code

The right of withdrawal is exercised correctly if the following conditions are fully met:

to. the right of withdrawal must be regularly exercised within fourteen (14) days of receipt of the products by following one of the methods indicated above;

b. the products must not have been used, worn, washed and, in any case, must comply with the requirements indicated in art. 3, below, on the conformity checks of returned products;

c. the identification tag, the Packaging such as box and envelope must be accompanied to the products as they are an integral part of the goods (see in this regard Article 5 below);

d. the products must be returned in their original packaging (if you want to return a kit, you must return all the items that compose it);

And. the returned products must be delivered to the shipper within fourteen (14) days from when you notified the Seller of your decision to withdraw from the contract;

f. the products must not be damaged.

If you have complied with all the required conditions, the Seller, in accordance with art. 56 of the Consumer Code, will reimburse you in full the price of the products purchased, remaining at your expense only the costs of the return, i.e. those for returning the purchased products to the Seller, unless the Seller has expressly exempted you from such expenses to the at the time of purchase and on the additional condition that you use the forwarder and the shipping methods suggested by the Seller in the following paragraph 


2. Method of returning products to the Seller

The Seller suggests using the DHL courier (http://www.dhl.com/) to return the purchased products. If you decide to use DHL for shipping and use the pre-printed adhesive label - bearing the return address - included in the package containing the purchased products, you will not have to pay the return costs yourself. In fact, the Seller will pay the courier on your behalf, deducting from your refund a lump sum equal to the cost previously incurred for the delivery of the purchased products to your home. Contact DHL to arrange collection. This shipping method also allows you to check, at any time, where each package is, freeing you from any responsibility in case of loss or damage to the products during transport. If, on the other hand, you decide to use a shipper other than DHL, you will have to pay the return costs yourself and you will be responsible for any loss or damage to the products during transport. It is understood that, in this case, an amount equivalent to the cost of standard shipping of the purchased products will also be refunded, while, in accordance with art. 56, paragraph 2, of the Consumer Code, any additional costs incurred by you for choosing a different and / or faster type of shipment and delivery than the standard one will not be reimbursed.


3. Conformity checks of returned products

You will be contacted if your return cannot be accepted because it does not comply with the conditions set out in lett. a) and e) of the previous paragraph 1 or in the hypothesis referred to in art. 59 of the Consumer Code and you can choose to have the purchased products back at your expense. If you refuse this shipment, the Seller reserves the right to keep the products and the amount corresponding to the purchase price of the products.

All products must be returned new and unused, in perfect condition, with all protective materials and with identification tags and stickers attached to the products (if any), as well as their packaging, accessories and documentation. If the product shows signs of use or if it has been used or altered from its original condition in any way, the Seller reserves the right not to accept the return or, alternatively, to reduce the amount of the refund or exchange. consequentially.

For example, the Seller may make a reduction in the refund in the following circumstances:

• the products have been used, worn, damaged or washed;

• the original packaging which is an integral part of the product has not been returned (eg Box, Warranty, Envelope)

You will be contacted if the Seller decides to reduce the refund for this reason. In this case, you can choose (as an alternative to the deduction of the refund) to have the purchased products back at your expense. In the latter case, if you refuse the shipment, the Seller will have the right to keep the products and the amount indicated for the reduction of the refund, due to the decrease in value of the returned products.

The Seller assumes no responsibility in the event of products returned by mistake or items forgotten in packages or returned products.


4. Refund times and methods

After the Seller has received your return and checked that all the requirements have been met, you will receive an e-mail confirming acceptance of the return and MARLI & CO. will proceed with the full refund, or, if there is a decrease in the value of the returned products, you will receive an e-mail in which you will be informed of the amount deducted by way of deduction of the refund and MARLI & CO. will refund the amount due. Whatever payment method you use among those available, the refund is activated by the Seller as soon as possible, and in any case within fourteen (14) days from the date on which you became aware of the exercise of your right of withdrawal, once we have verified that the withdrawal has taken place in compliance with the above conditions and the product / s returned to our offices.

The actual time for crediting or returning the sums you paid for the purchase of the products depends on the payment methods used:

• purchase by credit / debit card: the repayment time depends on the credit / debit card management company. We remind you that the value date of the re-credit is the same as the debit, so you will not suffer any loss in terms of bank interest;

• purchase via PayPal: the refund will be made to your PayPal account and will be immediately visible. The actual refund to the credit card from your PayPal account depends on the institution that issued the card;

• cash on delivery (if available): the refund takes place on the current account indicated by you, therefore the refund time depends on the correctness of the data you enter; normally the re-credit takes place within fourteen (14) days.

In the case of a gift, the reimbursement of the amounts will be made to the person who made the payment.

If you wish, as an alternative to reimbursement to your credit / debit card, PayPal account or current account indicated by you, at the time of exercising the Right of Withdrawal, you can choose to receive a Store Credit. You can use your credit for purchases on marliandco.it in the manner set out in art. 10 of the Conditions of Sale.


5. Products affected by defects or non-compliant

Without prejudice to the application of the mandatory rules for consumer protection, you can return a product because it is affected by defects or does not comply with the order, informing the Seller, within fourteen (14) days from the day you received the products purchased on marliandco. it, using the Return Form that you find in the Exchanges & Returns area; if the defect appears after fourteen (14) days, contact Customer Service for more information.

MARLI & CO. will check the products you have returned because they are affected by defects or do not conform to what was ordered and will proceed with the full refund, including shipping costs and the expenses you have incurred to return the products to MARLI & CO.

In the event that MARLI & CO. you do not detect any defect or lack of conformity in the returned products, you will be informed that your return cannot be accepted and you can choose whether to have the purchased products back. In case you refuse the shipment, MARLI & CO. will have the right to withhold the products and the amount corresponding to the purchase price of the products, as well as reserves the right to request the costs incurred.


6. Consumer Code

These Conditions for exercising the right of withdrawal, which are an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code.
